Multilateral Deals In A World of Non-Convergence

global dealsSir Philip Lowe addressed the theme of “120 Merger regimes: Multinational deals in a world of non-convergence: US, EU, Brazil, China…” at the GWU-Concurrences Conference in Washington on 19 September 2016.

This snapshot is a redacted version of Sir Philip’s introductory speech in which he reviews the goal of global convergence in the treatment of multi-jurisdictional deals by public agencies. Tackling genuine divergence in law is a real challenge. Ensuring full transparency, and independence of a competition agency in the application of law must surely be a prerequisite convergence. All countries with a competition regime, with the assistance of ICN, OECD and other concerned bodies, should urgently renew and reinforce their commitment to a set of standards for due process that will be fully reflected in the law and its application in all jurisdictions.
